1. Agreement to Terms

By downloading, installing, or using the HeyMedicaid mobile application ("App") and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). HeyMedicaid, Inc., a Delaware corporation ("HeyMedicaid," "we," "us," or "our"), provides the Services to help Medicaid beneficiaries ("Members," "you," or "your") access and manage their healthcare benefits.

If you do not agree to these Terms, you may not access or use our Services. We may update these Terms from time to time, and your continued use constitutes acceptance of any changes.

2. Description of Services

HeyMedicaid provides a mobile platform that enables Medicaid members to:

  • Access and manage Medicaid benefits and coverage information
  • Upload and store important healthcare documents
  • Receive notifications about benefit changes and renewals
  • Connect with healthcare providers in your network
  • Track medical appointments and prescription medications
  • Access telehealth services where available
  • Receive personalized healthcare guidance through AI-powered assistants

3. Eligibility and Account Registration

To use HeyMedicaid, you must:

  • Be a current or prospective Medicaid beneficiary
  • Be at least 13 years old (minors require parental consent)
  • Reside in a state where HeyMedicaid services are available
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.

4. HIPAA Compliance and Protected Health Information

HIPAA Notice: HeyMedicaid is committed to protecting your Protected Health Information (PHI) in accordance with the Health Insurance Portability and Accountability Act (HIPAA). We implement administrative, physical, and technical safeguards to ensure the confidentiality, integrity, and availability of your health information.

By using our Services, you acknowledge that:

  • We may collect, use, and disclose PHI as described in our Privacy Policy
  • We will only share PHI with covered entities and business associates as permitted by HIPAA
  • You have rights under HIPAA to access, amend, and receive an accounting of disclosures of your PHI
  • We maintain audit logs of all access to PHI within our system
  • We will notify you of any breach affecting your PHI as required by law

5. User Responsibilities and Prohibited Uses

You agree to use HeyMedicaid only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Provide false or misleading information about your identity or Medicaid eligibility
  • Share your account credentials with others
  • Attempt to access another user's account or health information
  • Use the Services for any fraudulent or illegal purpose
  • Interfere with or disrupt the Services or servers
  • Attempt to reverse engineer or hack our systems
  • Upload malicious code or viruses
  • Violate any applicable laws or regulations

6. Medical Disclaimer

IMPORTANT: HeyMedicaid is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or qualified healthcare provider with any questions about a medical condition. Never disregard professional medical advice or delay seeking it because of something you read or accessed through our Services.

In case of a medical emergency, call 911 or go to the nearest emergency room immediately. HeyMedicaid does not recommend or endorse any specific tests, physicians, products, procedures, or opinions.

7. Intellectual Property Rights

The Services, including all content, features, and functionality, are owned by HeyMedicaid, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any health information you provide through the Services, but grant us a license to use this information to provide and improve our Services, always in compliance with HIPAA and applicable privacy laws.

8. Termination

You may terminate your account at any time through the App settings or by contacting support. We may suspend or terminate your account if we reasonably believe you have violated these Terms or engaged in fraudulent activity.

Upon termination, your right to use the Services will immediately cease. We will retain and use your information as necessary to comply with legal obligations, resolve disputes, and enforce agreements.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYMEDICAID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to waive any right to a jury trial or to participate in a class action lawsuit. If arbitration is not permitted by law, disputes shall be brought in the state or federal courts located in Delaware.
